Terms of Use

Welcome to Tiny Minies. Tiny Minies is an interactive learning app where young children learn through games, books, tales, songs, videos, printable worksheets and other activities (the "Services").
Tiny Minies is operated by Gamester Egitim Bilisim ve Yazilim Teknolojileri A.S., a company incorporated under the laws of the Republic of Türkiye, with its registered address at Bilisim Vadisi Kocaeli Merkez Kampusu - Muallimkoy Mh. Deniz Cd. No:143-5 Gebze Kocaeli, Turkiye ("Gamester Kids," "we," "us" or "our").
Please read these Terms of Use ("Terms") and our Privacy Policy carefully. They govern your use of the Services. If you do not agree with them, please do not create an account, purchase a subscription or use the Services.
1. Who May Use the Services
The Services are used by two groups:
- Adult Users - individuals aged 18 or over, including parents, guardians, teachers and school administrators.
- Child Users - children who use the child-directed part of the Services under the supervision and authority of an Adult User.
Only an Adult User may create an account, purchase a subscription or agree to these Terms. A Child User may use the Services only through an Adult User's device or account.
If you are a parent, guardian, teacher or school administrator, you confirm that you have authority to accept these Terms on behalf of the children you authorize, that you consent to their use of the Services, and that you are responsible for ensuring their use complies with these Terms.
2. Changes to These Terms
We may change these Terms from time to time. If we make a material change, we will post the updated Terms with a new effective date and, where required by law, notify you by other reasonable means. Your continued use of the Services after the change takes effect means you accept the updated Terms. If you do not accept them, you should stop using the Services. Because the Services evolve, we may also change or discontinue features at any time.
3. Accounts and Profiles
Tiny Minies can be used without an account. Creating an account lets you use the Services on more than one device and keeps progress safe.
- Sign-in is by email address and a one-time confirmation code. We do not use passwords.
- You may create up to five child profiles under one account.
- You may use your account on up to five devices.
- You are responsible for activity that takes place under your account, for keeping your email address current, and for telling us promptly if you believe your account has been used without your permission.
- You may not sell, transfer or assign your account.
4. Free Version, Premium, Trials and Offers
Part of the Services is available free of charge. Full access to all content and features requires a paid subscription ("Premium").
Free trials.
Some plans include a free trial. Where a trial is offered, its length is shown before you subscribe. Unless you cancel at least 24 hours before the trial ends, your subscription will begin automatically and the applicable fee will be charged.
Introductory offers.
We sometimes offer a discounted first period instead of a trial. Where we do, the discounted price and the price that applies afterwards are both shown before you subscribe. The discount applies to the first period only.
Content changes.
We add new content regularly, and we may also change or remove content. Premium gives you access to the content available at the time you use the Services; it is not a guarantee that any particular title will remain available.
5. Purchases, Renewal and Cancellation
How you can purchase.
- Through the Apple App Store or Google Play, under their terms as well as these Terms
- Through a partner, operator or reseller, where payment and administration may be handled by that partner under their own terms in addition to these Terms
- Through an access code provided by a school, employer or partner
- Directly from our website, where and when we offer this
Automatic renewal.
Subscriptions renew automatically for the same period unless cancelled before the renewal date. You authorize the charge for each renewal at the price then in effect. If we change the price, we will tell you in advance and give you the chance to cancel before the new price applies.
Cancellation.
- Subscriptions purchased through the App Store or Google Play must be cancelled in the store where they were purchased. Deleting the app does not cancel a subscription.
- Subscriptions purchased directly from us can be cancelled by contacting us, or through your account where that option is available.
- After cancellation you keep access until the end of the period you have already paid for.
Refunds and our 14-day promise.
If Tiny Minies is not right for your family, tell us within 14 days and we will help put it right.
- The 14 days run from the date your subscription starts. Where your plan includes a free trial, the trial is part of that period, and in every case you will have at least 7 days from the date of your first charge.
- Purchases made through the App Store or Google Play are refunded by Apple and Google under their own policies, and we are not able to issue those refunds ourselves. We will look at your account, confirm the dates, and support your request with the store.
- Purchases made directly from us are refunded by us, to the payment method you used, within 14 days of us accepting the request.
None of this affects any rights you have under applicable consumer law.
Access codes and gifts.
Codes and gift subscriptions may be subject to additional terms shown at the time they are issued. Codes have no cash value, cannot be resold, and may expire.
6. Buying Directly From Our Website
This section applies to purchases made directly from us on our website, in addition to the sections above. It does not apply to purchases made through the App Store, Google Play or a partner.
Before you buy.
Before completing your order we will show you what you are buying, the total price including any applicable taxes, the length of the subscription and when it renews, and the payment methods accepted. Prices are shown in the currency displayed at checkout.
When your access begins.
Tiny Minies is digital content, and access begins as soon as your payment is confirmed. At checkout you will be asked to confirm that you want access to begin immediately, and to acknowledge that, once it has, your statutory right of withdrawal for digital content no longer applies. If you prefer not to give that confirmation, access will begin after the statutory withdrawal period ends.
Our 14-day promise still applies.
Whether or not the statutory right applies, we give you our own 14-day promise: if Tiny Minies is not right for your family, contact us within 14 days of your subscription starting and we will refund you. Refunds are made to the payment method you used, within 14 days of us accepting your request.
Cancelling a website subscription.
You can cancel at any time by contacting us or, where available, from your account. You will keep access until the end of the period you have paid for, and you will not be charged again.
If something goes wrong.
Please contact us first: most issues are resolved quickly. If you are a consumer resident in Türkiye and we cannot resolve the matter, you may apply to the consumer arbitration committee (Tüketici Hakem Heyeti) or the consumer court in your province. Consumers in the European Union and the United Kingdom keep the protection of the mandatory consumer rules of the country where they live.
7. Parental Controls and Screen Time
The Services include tools that let a Parent set a daily screen time limit for each child profile, choose which content is available, and review progress. These tools are provided to support you, not to replace supervision. We do not guarantee that a child cannot find a way around them, and we are not responsible for how the tools are configured or used.
Progress Reports are intended to help you follow your child's learning. They are not an assessment, a diagnosis, or a measure of a child's ability, and should not be relied on as such.
8. Our Content and Your License to Use It
Ownership.
The Services and all content within them - including games, stories, videos, songs, characters, artwork, sound, text, printable activities, software and the design and arrangement of the Services - are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws in Türkiye and internationally.
Your license.
Subject to these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, revocable, non-transferable license to use the Services for personal, non-commercial family use.
- Printable activities may be printed as many times as you need for your own family or, if you are a teacher, for the children in your own class.
- Content downloaded for offline use remains part of the Services and may only be used within the app.
- You may not copy, distribute, publish, sell, sublicense, modify, translate, reverse engineer or create derivative works from the Services or their content, except as these Terms expressly allow.
Classroom and institutional use.
Use by a school, nursery or other institution beyond a single teacher's own class requires a separate agreement with us. Contact us to arrange this.
9. What Your Child Creates, and What You Send Us
Pictures your child colors, characters they create and similar creations stay within the app on your device, and can be saved to your device if you choose. We do not collect them, and we claim no rights over them. They belong to your family.
If you choose to send us something - a message, a photograph, a suggestion, a competition entry or a post on our social channels - you keep ownership of it, but you give us permission to use it in connection with the Services and our communications about them. Do not send us anything you would not want us to use, and do not send us anything that belongs to someone else.
We may, but are not obliged to, review, edit or remove material sent to us.
10. Acceptable Use
You agree not to:
- Use the Services for anything unlawful, harmful, deceptive or offensive
- Interfere with the Services, their security, or other people's use of them
- Reverse engineer, decompile or attempt to extract the source code of the Services
- Collect data from the Services by automated means, such as scrapers or bots
- Use the Services commercially or in a classroom beyond the permitted scope without an agreement with us
- Circumvent any limitation on access, including parental controls, device limits or subscription restrictions
- Use our trademarks, characters or content in a way that suggests we endorse you
11. App Stores and Third Parties
Apple.
If you obtained the app from the App Store: these Terms are between you and us, not Apple, and Apple is not responsible for the app or its content. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google.
If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. These Terms are between you and us, not Google, and Google is not responsible for the app or its content.
Other third parties.
The Services may link to or include material from third parties. We are not responsible for third-party sites, products or services, and their terms and privacy practices apply to them, not ours.
12. Privacy
Our Privacy Policy explains what information we collect, how we use it and the choices available to you and your child. It forms part of your agreement with us.
13. Suspension and Termination
You may stop using the Services at any time, and may delete your account from the Parents Area or by contacting us.
We may suspend or end your access to the Services if you breach these Terms, if we reasonably suspect fraud or misuse, or if we discontinue the Services. Where it is reasonable to do so, we will give you notice. Ending your access does not affect payment obligations already incurred, and does not entitle you to a refund except where required by applicable law.
14. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we do not warrant that the Services will be uninterrupted, error-free or free of harmful components, that any defect will be corrected, or that the Services are suitable for a particular purpose.
We do not promise any particular educational outcome. Children learn differently and at different paces, and use of the Services is one part of a child's wider learning environment.
Nothing in these Terms excludes or limits any right you have under mandatory consumer protection law, including any statutory warranty or right to a remedy.
15. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive losses, or for loss of profit, goodwill or data, arising out of or connected with your use of the Services.
To the fullest extent permitted by law, our total liability in connection with the Services will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or USD 100.
These limits do not apply to liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.
16. Indemnity
To the extent permitted by law, you agree to indemnify us against claims, damages and reasonable costs arising from your breach of these Terms, your misuse of the Services, or your violation of the rights of another person. This does not apply to the extent the claim results from our own act or omission.
17. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye. The courts of Istanbul, Türkiye have jurisdiction over any dispute arising out of or relating to these Terms or the Services.
This does not deprive you of the protection of mandatory rules of the law of the country where you live. In particular:
- If you are a consumer resident in Türkiye, you may also apply to the consumer arbitration committee (Tüketici Hakem Heyeti) or the consumer courts in your own province, as provided by Law No. 6502 on Consumer Protection.
- If you are a consumer resident in the European Union or the United Kingdom, you may bring proceedings in the courts of the country where you live, and you benefit from the mandatory consumer protection rules of that country.
Before starting formal proceedings, we ask that you contact us so that we can try to resolve the matter directly. Most issues are resolved quickly this way.
18. General
Entire agreement.
These Terms, together with the Privacy Policy and any additional terms presented for a specific offer, form the entire agreement between you and us about the Services. Where additional terms conflict with these Terms, the additional terms apply to that specific offer.
Severability.
If any provision is found unenforceable, the rest remains in force and the unenforceable provision will be applied as closely as possible to its original intent.
No waiver.
If we do not enforce a provision, that is not a waiver of our right to enforce it later.
Assignment.
We may transfer our rights and obligations under these Terms, for example as part of a corporate transaction. You may not transfer yours without our consent.
Force majeure.
We are not liable for delay or failure caused by events beyond our reasonable control.
Notices.
We may send notices to the email address associated with your account. You may send notices to us at the address below.
Survival.
Sections 8 (Our Content), 9 (What Your Child Creates), 10 (Acceptable Use), 14 (Disclaimers), 15 (Limitation of Liability), 16 (Indemnity), 17 (Governing Law and Disputes) and 18 (General) survive termination.
